1. PAYMENT TERMS

Once a commission is agreed upon a 50% deposit is required to secure the client's booking and payment must be made within 24 hours to retain their space on the waiting list. If payment is not made within the timeframe, tranSMITart will forfeit their booking. The other 50% of the remaining balance is due once the client's commission is complete. Deposits are non-refundable except in the unfortunate event where tranSMITart may have to cancel the client's portrait due to uncontrollable circumstances, whereby tranSMITart will refund the client's deposit in full.

2. OWNERSHIP OF ARTWORK

tranSMITart retains ownership of all original artworks or parts contained within, whether preliminary or final. tranSMITart retains the right to photograph the finished commission and any preliminary work for the purpose of marketing. If the commission is a gift, tranSMITart will refrain from posting to their social media accounts or website until the client grants permission. The finished artwork may be used by the client for display and personal enjoyment only. No prints or copies shall be made, or profit gained in any way from the finished artwork by the client without the express written permission of the artist.

3. PRODUCTION SCHEDULE/ DELIVERY OF COMMISSION

A commission time frame is usually 2-6 weeks for a pastel portrait and 1-2 weeks for a cartoon portrait, depending on the number of subjects, detail and portrait size. Once the client's portrait has commenced, they will be kept up to date with regular work in progress photos via social media or email if they wish to keep it secret for the time being. If the client wishes to have their portrait completed by a specific date such as a birthday, anniversary or for Christmas tranSMITart will do their best to accommodate the request. Most commissioned artworks are couriered unframed and flat packed - sandwiched between two boards then packaged in a courier bag or cardboard envelope to ensure it reaches the client in perfect condition. Larger cartoon portraits will be rolled and placed in a tube. Postage within New Zealand is $7.50 for A5, $11.90 for A4, $12.50 for A3 and $15.50 for A2 sized portraits. To courier larger portrait sizes and to ship worldwide please contact tranSMITart for a quote. Portraits will only be couriered once the final 50% of the remaining balance has been paid.

4. CHANGES

If the client wants a different photo for their portrait or another composition after they have already agreed upon the composition or photo used, and the artist has already started adding colour or shading into the portrait, then tranSMITart is entitled to charge an additional 75% of the original price to start over.
